Why Tap A Cell Phone? Reason #3 (Employee Monitoring)

tapcellphonesoftware Why Tap A Cell Phone? Reason #3 (Employee Monitoring)

The third most popular reason why someone would want to tap a cell phone is to monitor their employee cell phone use to enforce quality control.

There are a lot of companies (big and small), who provide company issued cell phones in order to communicate with customers. As mobile phones become more powerful, they are increasingly used as the primary communication device for employees to interact with their customers.  Today's cell phones enable any employee to talk to customers via chat, email, or voice.  There is no longer any reason for having to use a company provided PC if an employee is in the field.  Think of all the work that can be done from just a single iPhone or BlackBerry.  You can do just about anything these days with either phone and the plethora of apps available for each device.

The problem with employees using their cell phones as the primary tool for communicating with customers, is that  employers no longer have way to enforce their own quality control policies and standards.  It's easy to monitor a call when the calls are placed from within the company, but once the employee leaves the office, what options does an employer have? This is where cell phone monitoring software sold by companies such as MobiStealth & Spyera come into play.

Both MobiStealth & Spyera offer spy phone software that enables employers to proactively monitor their employee cell phone use.  This includes live calls, email, and text message communication.  Out of the two, MobiStealth probably does a better job because it records the calls versus just offering live call tapping.  The recording of calls is a very important feature in my opinion because this will enable an employer to sit down with their employee and review the call.  When using Spyera, an employer would have to resort to putting the call on speaker phone and recording it.

Either option would work, but to truly use it as a employee monitoring tool which can then be used to provide constructive feedback to the employee, MobiStealth comes out on top for the ability to record the calls.

Now if you are an employer, before you rush out to go buy either product, you should be aware that when monitoring employee calls in California, state law requires that both parties on the call be informed that the conversation is recorded or monitored . (California Public Utilities Commission General Order 107-B)

Moreover, Federal law, which regulates phone calls with persons outside the state, does allow unannounced monitoring for business-related calls. (See Electronic Communications Privacy Act, 18 USC 2510)

A final point to bring up that be very careful if you are an employer and you happen to listen in on a personal call.  Under federal case law, when an employer realizes the call is personal, he or she must immediately stop monitoring the call.  However, when employees are told not to make personal calls from specified business phones, the employee then takes the risk that calls on those phones may be monitored. This means it's up to you as an employer to set the proper policies in place prior to issuing company provided cell phones.
